We have partnered with the SCC Arbitration Institute to bring you the first ABCS Talks for 2026.
—
Cross-border contract disputes can be costly, hard to navigate, and pose potential risks to businesses.
During this breakfast talk, the SCC Arbitration Institute will explore and explain how to avoid and minimise risks associated with contract disputes.
Former ABCS Board Member, Jake Lowther will talk through the “midnight clause”, a contract's dispute resolution clause that often gets limited attention during negotiations. Jake will delve into how choices made in contract negotiations can have decisive consequences after the deal is done.
The talk will also provide practical tips and strategies for drafting effective dispute resolution clauses. During the presentation and discussion, SCC will provide invaluable tips on:
When different dispute resolution methods are most suitable
What to include in the contract
What to avoid in the contract
This information will help HR, Legal, and C-Suite professionals excel in negotiations – reducing costs and saving time during a potential dispute resolution.
The talk and Q/A session will run for about 45 minutes to an hour with 30 minutes to an hour for networking

SCC Arbitration Institute provides a neutral, independent, and impartial venue for dispute resolution in commercial business around the world. They keep at the forefront of change to meet the developing needs of the business community.
